- Patent agents need not be lawyers or attorneys and will not necessarily be required to bring cases in a court of law. Patent attorneys/advocates within the firm would take on the prosecution ,litigation .Patent agents may choose to pursue law degrees in addition to Engineering to become Patent Attorneys/Advocates and handle dual responsibility as part of their career progression.
- Patent agent’s job will involve Patent Filing and Drafting with an eye toward anticipating any questions or objections the reviewer namely the Controller general of Designs and Trademarks might have.
- Patent agents will be the first to learn of New Technological inventions and will help inventors ensure that they are entitled to the intellectual property right that prevents others from using their invention in any way for a certain period of time and that there are no other similar inventions that prevent it from receiving a utility, design or plant patent conferred by the Controller general of Designs and Trademarks.
- As a Patent agent you will have the privilege to be the first person to learn about a new Technical Innovation.
- You will then Research other similar inventions and discusses the concept with other inventors to determine if there is any similarity to another invention that might prevent a patent from being issued.
- Suggest modifications or extensions to the definition of the invention.
- Prepare detailed technical descriptions of inventions in precise legal terms (patent drafts) with assistance from the Patent advocate/Patent Attorney within the firm
- Handle complicated technical arguments.
- Advise on whether patent will infringe someone else’s patent rights.
- Ensuring application and renewal deadlines are met.
- Preparing responses to reports from patent examiners with advise from the Patent advocate/Patent Attorney within the firm
